Landslip

Once upon a time, a buyer purchased a lot in the mountains. The lot sloped downward from the street. He chose the lot because of the majestic view of the city.

One day, the buyer decided to visit the lot only to discover that it had disappeared. As it turns out, non-stop rain the previous weekend softened the soil and the lot eroded.

He checked with his contractors on whether he could still build on it and how much it would cost. He received a figure that would make it better to cut his loss and forget about the lot than to build on it.

What if this happened to a pre-selling lot before/after turnover? Do you think the developer would refund the buyer if the lot eroded?
